i have been with a non pro fit organazation for 8yrs have not had a pay raise or vacation pay and eliglbe for?
in the job handbook regular part workers are eligible for life insurance which i have never received" and i work every holiday without pay and have never recevied a paid vacaction i work in a domestic violence shelter" i am a security guard" i beleive if i am eligible for life insurance i should be eligible for other benefits" please help me"
Latanya:
Unfortunately, job benefits are offered as an employment privilege in the US, not as a right. The labor laws in this country do not create an entitlement to paid vacation, life insurance, or any similar benefit, regardless of how long you have worked in a particular place. Those are contractual matters that are negotiated between the employer and employee.
From the Department of Labor site:
"The Fair Labor Standards Act (FLSA) does not address benefits such as life insurance, long-term care insurance, medical insurance accounts or wellness benefits. These benefits are generally a matter of agreement between an employer and an employee (or the employee's representative)."
When you say that work every holiday "without pay", I presume that you mean without getting paid a special "holiday" rate. The Fair Labor Standards Act (FLSA) does not require employers to pay any special, or overtime rate for holidays, not does it require employers to pay employees who do not work on those days. There are exceptions to this policy if your employer is engaged in the performance of government contracts.
Don't get me wrong - there are plenty of rules and regulations that apply to employment conditions and compensation - for example, it IS required that an employer pay at least time-and-a-half to non-exempt employees for any hours worked beyond 40 hours in a workweek. Even in that case, though, there are a lot of exemptions to the law, exemptions that apply to all different kinds of employees, in all different kinds of fields.
You may also be entitled to certain types of family and medical leave - though that leave does not have to be paid leave. All the employer must do is continue to protect your position - they can't fire you for taking legitimate time off. But again - there are plenty of exceptions here - this law only applies to companies with more than 50 employees.
It sounds as if you work for an unreasonable employer who is more than happy to take advantage of your 8 years of service. Unfortunately, your unreasonable employer is probably offering you a legal, if crappy, employment relationship. Even in these difficult economic times, there has to be other local employers who offer better terms to experienced security staff. You should put together a resume and begin making inquiries around the area.
I'm sorry for the disappointing news - I wish you the best of luck in finding a better position elsewhere.
